2. USERS:Accessing and/or using this portal confers the status of USER, who accepts, from said access and/or use, the General Terms of Use set out herein. 

3. USE OF THE PORTAL:www.oban.esprovides access to a multitude of information, services, programs and data (“the content”) on the Internet owned by OBAN or third parties. The USER assumes responsibility for their use of the portal. 

The USER agrees to make appropriate use of the content and services that OBAN offers through its portal, including, but not limited to, not using them to: (i) participate in any illegal or illicit activities, or activities that go against good faith or public order; (ii) disseminate content or propaganda of a racist, xenophobic, or pornographic-illegal nature, or that advocates terrorism or the violation of human rights; (iii) cause damage to any type of physical or logical systems of the company OBAN, its suppliers or third parties, entering or spreading computer viruses or any other physical or logical systems that are liable to cause the aforementioned damage; (iv) attempt to access or, where appropriate, use the email of other users or modify or manipulate their messages.

The viewing, printing and partial downloading of the website content is authorized solely and exclusively when the following conditions are met:

• It is compatible with the purposes of the website oban.es.
• It is done with the sole intention of obtaining the information contained for personal and private use. Its use for commercial purposes or for distribution, public communication or transformation is expressly prohibited.
• None of the content related to this website is modified in any way.
• No graphics, icons or images available on this website are used, copied or distributed separately from the text or the rest of the images that accompany it.

4. DATA PROTECTION AND PRIVACY: The personal data obtained through this portal will be directly processed by OBAN LEGAL S.L.P., whose contact information has already been detailed.

Personal data will only be processed for as long as they are necessary, useful and relevant. Likewise, they will only be stored for the sole purpose of, and for the time necessary for, compliance with the applicable legal obligations. INTELLECTUAL AND INDUSTRIAL PROPERTY: All the content on OBAN’s website, including, but not limited to, texts, documents, photographs, drawings, images, icons, graphic representations, audiovisual content or sounds, as well as its graphic design and source codes, trademarks, trade names or other distinctive signs, are the exclusive property of OBAN or third parties and are protected by Intellectual and Industrial Property Laws, unless specified otherwise.  

The user must respect all intellectual and industrial rights on OBAN’s website that are the property of OBAN or third parties. The infringement of any of the aforementioned rights may constitute a violation of the Intellectual and Industrial Property laws as well as a crime punishable in accordance with Article 270 et seq. of Organic Law 10/1995, of November 23, on the Criminal Code.

6. WARRANTY AND LIABILITY DISCLAIMER: OBAN does not guarantee continued access to, or the correct visualization, download or usefulness of, the elements and information contained on its website, which may be obstructed, hindered or interrupted due to various circumstances beyond its control. 

OBAN does not assume any liability in relation to the content provided by third parties or entities that has been accessed through its website, and especially not for the damages of any kind that may occur in this regard for reasons that include, but are not limited to: (i) absences or deficiencies in the information provided to the users or the accuracy, truthfulness or sufficiency thereof; (ii) infringement of the rights of consumers and users; (iii) infringement of the intellectual and industrial property rights; the performance of acts of unfair competition or illegal advertising; (iv) infringement of data protection rights; (v) professional secrecy and rights to a person’s honor, respect for private and family life and self-image; and (vi) in general, the breach of any applicable laws, customs or codes of conduct.

Access to the portal does not imply an obligation for OBAN to control the absence of viruses or any other harmful computer elements. In any case, it is the responsibility of the User to have the adequate tools for the detection and disinfection of potentially harmful computer programs.

8. MODIFICATIONS: OBAN reserves the right to make any modifications it deems appropriate to its portal, without prior notice, changing, deleting or adding content or services provided therein as well as changing the manner in which they are presented or their location in its portal.

9. RIGHT TO EXCLUSION: OBAN reserves the right to restrict access to the portal and/or the services offered without prior notice, at its own or a third party’s decision, for those users who fail to comply with these General Terms of Use as well as any subsequent modifications thereto.

10. GENERAL INFORMATION:OBAN will persecute the breach of these conditions, as well as any improper use of its portal, exercising all civil and criminal actions that could be applicable by law.

11. MODIFICATION OF THESE TERMS AND VALIDITY PERIOD: OBAN may modify the terms set out herein, duly publishing them at any given time. These terms will be valid in accordance with what is stated herein and will be in force until their modification by other terms that are duly published.

APPLICABLE LEGISLATION AND JURISDICTION: For the resolution of any conflict arising from the access to the website, the USER and OBAN expressly agree to submit to the Spanish laws in force and to the courts and tribunals of the city of Madrid, waiving any general or special jurisdiction they might be entitled to.
